General Terms and Conditions & Consumer Information
§ 1 Scope and Provider
These General Terms and Conditions (GTC) apply to the use of the LifeScale platform (life-scale.de) operated by [Company name, address] (the “Provider”) by consumers (§ 13 German Civil Code) and entrepreneurs (§ 14 German Civil Code) (the “User”).
Deviating, conflicting or supplementary terms of the User shall only become part of the contract if and to the extent that the Provider has expressly consented to their application.
§ 2 Description of Services
LifeScale provides a digital platform that supports users in planning an international relocation, including personalised country recommendations, job and housing listings, information on visas, taxes and official procedures, checklists and AI-assisted guidance.
The information provided serves general orientation only and does not constitute legal, tax or migration advice. Binding information is given solely by the competent authorities and qualified advisors.
§ 3 Conclusion of Contract
The presentation of plans on the platform does not constitute a binding offer but an invitation to submit an offer. By completing the order process (clicking the payment button), the User submits a binding offer. The contract is concluded upon the Provider’s confirmation or activation of the plan.
The contract text is stored by the Provider; the order details are sent to the User by email. The contract language is German.
§ 4 Registration
Registration is free of charge. By registering, the User confirms that they are at least 18 years old and have full legal capacity. The User is responsible for the confidentiality of their access data and must inform the Provider immediately if there are indications of misuse of their account.
§ 5 Prices, Subscriptions, Term and Cancellation
5.1 Prices and billing: Paid plans are billed in advance, either monthly or annually. All prices include the applicable statutory VAT. Payment is processed via our payment service provider Stripe.
5.2 Term: Monthly plans have a minimum term of one month and renew automatically for one further month at a time. Annual plans have a minimum term of 12 months and, after expiry, renew automatically for one further month at a time (not for another full year) unless cancelled — implementing § 309 No. 9 German Civil Code.
5.3 Cancellation: Consumer contracts in electronic commerce can be cancelled at any time via the cancellation button in the app’s billing area (§ 312k German Civil Code) or by email to support@life-scale.de. After cancellation, the paid plan remains active until the end of the already-paid billing period and then automatically switches to the free plan.
5.4 Payment default: If a charge fails, the Provider grants a grace period of 7 days. After it expires unsuccessfully, the subscription may be deactivated.
§ 6 Right of Withdrawal and Expiry Thereof
6.1 Right of withdrawal: Consumers have a 14-day right of withdrawal pursuant to § 355 German Civil Code / Art. 9 of Directive 2011/83/EU. The withdrawal period is 14 days from the date of conclusion of the contract.
6.2 Exercise: To exercise your right of withdrawal, you must inform us ([Company name, address], email: support@life-scale.de) of your decision by means of a clear statement (e.g. email). You may use the statutory model withdrawal form, but this is not mandatory.
6.3 Early expiry: The right of withdrawal expires early for contracts on the supply of digital content/services if the Provider began performance only after the consumer gave their express consent and at the same time confirmed their awareness of losing the right of withdrawal upon full performance of the contract (§ 356 (4)/(5) German Civil Code; Art. 16 (a)/(m) Consumer Rights Directive).
6.4 Consent at purchase: By concluding a paid plan, you expressly confirm by actively ticking the checkbox during the order process: “I expressly request that LifeScale begin performance of the ordered service before the end of the withdrawal period. I am aware that my right of withdrawal expires upon full performance of the contract.” Without this consent, no paid plan can be concluded.
6.5 Consequences of withdrawal: In the event of an effective withdrawal — i.e. where the service has not yet been fully provided — we will refund all payments received without undue delay, at the latest within 14 days of receipt of the withdrawal notice, using the same means of payment.
§ 7 User Obligations and Content
The User undertakes not to post any unlawful, offensive, discriminatory or rights-infringing content (e.g. in the community). The Provider is entitled to remove content that violates applicable law or these GTC.
For content posted by the User, the User grants the Provider a simple, non-exclusive right of use for the purpose of display within the platform.
§ 8 Availability
The Provider endeavours to keep the platform available as uninterruptedly as possible but does not owe such availability. Maintenance work, force majeure or disruptions outside the Provider’s control may lead to temporary restrictions.
§ 9 Limitation of Liability
The Provider is liable without limitation in cases of intent and gross negligence, as well as under the Product Liability Act and for injury to life, body or health. In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical of the contract.
Otherwise, liability is excluded. In particular, the Provider is not liable for the accuracy and completeness of the information provided; the platform does not replace legal or tax advice.
§ 10 Amendments to the GTC
The Provider reserves the right to amend these GTC with 30 days’ notice insofar as this is necessary and does not unreasonably disadvantage the User. The User will be informed of changes by email. If the User does not object within the period and continues to use the platform, the amended GTC are deemed accepted; this will be specifically pointed out in the notification. In the event of objection, there is a special right of termination.
§ 11 Applicable Law, Place of Jurisdiction and Dispute Resolution
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in the EU, mandatory consumer protection provisions of their home law remain unaffected.
If the User is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the Provider’s registered office.
Online dispute resolution: ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Severability Clause
Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The statutory provision shall replace the invalid provision.
